Terms and conditions

1. Preamble

The BÈLTIKÈ company publishes this Site, accessible via the Internet and in the form of a mobile application, on which you can reserve Seats for Bus Trips, which will be provided either by Coach Operators with whom BÈLTIKÈ has concluded partnership agreements.
The purpose of these General Terms and Conditions of Use of the Site and Reservation (“GTU”) is to regulate access to and the terms of use of the Site and Ticket reservations. We invite you to read it carefully.

We would like to draw your attention to the fact that BÈLTIKÈ may use different Coach Operators, as indicated in the General Conditions of Sale of Transport ("GTC") on the Site, for the performance of transport services ordered by its Clients ; for this reason the vehicles do not belong to us. BÈLTIKÈ may offer, in its name and on its behalf and in the name and on behalf of its Partners, services (“Ancillary Services”), such as:

Choice of specific seats;
Shopping vouchers;
Promo Codes. The reservation conditions for these Ancillary Services are specified in the T&Cs.

2. Definitions

"Bus Advertisement" means an advertisement for a Bus Trip posted on the Site;

"Mobile Application" means the application software, possibly developed by BÈLTIKÈ, which once put into service, can put, on a mobile electronic device, the same Services and Additional Services as those normally offered on a computer through the Site;

"Coach operator" means a passenger coach transport company with which Beltike has entered into a partnership agreement;

"Ticket" means the valid nominative transport ticket given to the Customer, following the Order, constituting proof of the existence of a transport contract between the Passenger and BÈLTIKÈ (or the Coach Operator), which contract is governed by the T&Cs, without prejudice to any additional special conditions stipulated between the Passenger and BÈLTIKÈ (or the Coach Operator) and referred to on the Ticket;

"Bellike" has the meaning given to it in Article 1 above;

“General Conditions of Use” (“GCU”) means these general conditions of use and reservation;

“General Terms and Conditions of Sale” (“GTC”) means the general terms and conditions of sale of transport services from BÈLTIKÈ or its Partners concerned, depending on the Trip selected by the Customer, and the specific applicable conditions, accessible on the Site, and that the Customer acknowledges having read before placing his Order;

"Customer" means any natural person who has purchased, either on his own behalf or on behalf of a third party who will be the Passenger, a Ticket through the Site or the Mobile Application to carry out a Journey operated by BÈLTIKÈ or by the Coach Operator;

"Order" means the operation by which the Customer reserves all Benefits and Additional Services with BÈLTIKÈ, regardless of the reservation method used, except in the case of purchase at a Point of Sale, and which entails the obligation for the Customer to pay the price relating to the Services and Ancillary Services concerned;

"Customer Account" designates a possible digital space, which as soon as it is put into service, is reserved for the Passenger or his possible Representative accessible on certain Sites and certain possible Mobile Applications by means of an identifier and a code in which information specific to the Passenger (Personal Information, reservations, bank cards, Vouchers, etc.) is stored with a view, in particular, to pre-filling the Passenger's information during subsequent Orders;

"Agent" means the Customer who places the Order for the Passenger as a third party and declares to act in the name and on behalf of the Passenger, beneficiary of the Services ordered by him, of which he acknowledges being the agent within the meaning of the regulations. applicable;

"Member" means any natural person who has created a Customer Account on the Site;

“Passenger” means the natural person who ordered the Ticket;
“Seat” means the seat reserved by a Passenger on board a vehicle (bus or coach) operated by BÈLTIKÈ or by a Coach Operator and which is evidenced by the issuance of a Ticket;

“Point of Sale” means the counters or physical terminals listed on the Site and in which the Tickets are offered for sale;

“Partner” has the same meaning as Autocariste;

“Services” means the transport service(s) subscribed to by the Passenger and provided by BÈLTIKÈ or its Partners;

“Price” means the price including all taxes, fees and related service costs, requested by BÈLTIKÈ from the Customer, at the time of validation of the Order, for a Seat on a given Bus Journey;

“Reservation” has the meaning given to it in article 4 below;

“Services” means all the services provided by BÈLTIKÈ through the Site and the Mobile Application, namely the Services and Additional Services;

“Ancillary Services” has the meaning given to it in article 1 above;
"Site" means the website published by BÈLTIKÈ accessible, depending on the country from which it is accessed, at the addresses indicated in section IV hereof, "LINKS TO SITES AND APPLICATIONS";

"Booking System" has the meaning given to it in Article 4 below;

“Journey”: refers to the particular itinerary chosen by the Passenger or his potential Representative and which includes, in whole or in part, one or more line(s);

“Bus Trip” means a Coach Trip.

3. Registration on the Site

3.1. Conditions of registration on the Site
The use of the Site is reserved for natural persons aged 18 or over. Any registration on the Site by a minor to create a possible Customer Account, when this functionality is put into service is strictly prohibited. By using or registering on the Site, you represent and warrant that you are 18 years of age or older. The Site allows Passengers to book Bus Trips. You can consult the schedules of Bus Journeys even if you do not buy Tickets. To be able to access the Site and buy Tickets there, you must have read and accepted these T&Cs as well as the Privacy Policy as indicated on the Site.

3.2. Verification
BÈLTIKÈ may, for the purposes of transparency, improving trust, or preventing or detecting fraud, set up a verification system for some of the information that you may provide on your profile in your Customer Account if necessary. . This is particularly the case when you provide your telephone number or provide us with an identity document.

3.3. Use of Site data
The Site is made available for strictly personal and non-commercial purposes. It can only be used to check the availability of Bus Trips, create a Customer Account and/or place Orders. Any use of automatic systems for extracting data from the Site for direct or indirect commercial purposes, in particular with a view to displaying this data, in whole or in part, on another Internet site, is prohibited, except with the prior written authorization of BELTIKE. BÈLTIKÈ reserves the right to block access to the Site in the event of its proper functioning and functionalities being impaired, in particular by sending corrupt files or viruses, or by a number of operations exceeding normal use, and more generally in the event of violation of these T&Cs, immediately without prior notification and without prejudice to any legal action and claim for compensation.

4. Use of the Services

BÈLTIKÈ has set up an online Seat reservation system (the “Reservation”) for the Trips offered on the Site.

4.1. The trip by bus
BÈLTIKÈ offers on the Site to reserve a Ticket for a Bus Journey. The Services may be offered by Bèl tikè in its name and on its behalf, but also in the name and on behalf of its Partners. They are governed by these T&Cs as well as by the T&Cs of BÈLTIKÈ or its Partners concerned, depending on the Journey selected by the Customer, which T&Cs must be accepted by the Customer before placing the Order. BÈLTIKÈ draws your attention to the fact that it may happen that certain Services offered by its Partners and appearing on the Site are deleted, in particular for climatic reasons, seasonal peaks or in the event of force majeure.

4.2. Nominative nature of the Seat Reservation and booking methods on behalf of a third party
Any Seat reservation for a Journey is nominative. However, BÈLTIKÈ allows Customers to reserve one or more Seats on behalf of a third party, acting as Agent. In this case, the Agent undertakes to accurately indicate to BÈLTIKÈ and, where applicable, to the Partner concerned, at the time of Booking, the first name, age and telephone number of the person on whose behalf you are booking a Square. We invite you to read the relevant T&Cs for the reservation conditions for Bus Trips for Passengers, and more particularly for minors, alone or accompanied, and Passengers with reduced mobility before paying for the Order. In addition, the Site is intended for the reservation of Seats for natural persons. It is therefore forbidden to reserve a Seat for the transport of an object, parcel, animal traveling alone or any material item.

5. Financial conditions

The Passenger is invited to refer to the relevant T&Cs (Article "Terms of Order Placement") in order to find out about the terms and conditions for placing the Order and paying for the Ticket.

6. Exchange and Cancellation Policy

The Passenger is invited to refer to the relevant T&Cs (Article "Exchange, cancellation and refund conditions") in order to find out the conditions for exchanging and canceling their Bus Trip.

7. Behavior of users of the Site

7.1. Commitment of all users of the Site You acknowledge that you are solely responsible for compliance with all laws, regulations and obligations applicable to your use of the Site. Furthermore, by using the Site and during the Trips, you agree to: (i) not transmit to BÈLTIKÈ (in particular when creating or updating your Customer Account) or to other Coach Operators any false or misleading information , misleading or fraudulent;
(ii) not to infringe the rights and image of BÈLTIKÈ, in particular its intellectual property rights;
(iii) not to open more than one Client Account on the Site and not to open a Client Account in the name of a third party;
(iv) comply with these T&Cs and the Privacy Policy.

7.2. Commitments of Passengers As part of a Bus Trip, the Passenger undertakes to comply with the relevant T&Cs.

8. Operation, availability and functionalities of the Site

BÈLTIKÈ will endeavour, as far as possible, to keep the Site accessible 7 days a week and 24 hours a day. Nevertheless, access to the Site may be temporarily suspended, without notice, due to technical maintenance operations, migration, updates or due to breakdowns or constraints related to the operation of the networks. In addition, Bèltikè reserves the right to modify or interrupt, at its sole discretion, temporarily or permanently, all or part of the access to the Site or its functionalities.

9. Personal data

As part of your use of the Site, BÈLTIKÈ collects and processes some of your personal data. By using the Site and registering as a Member, you acknowledge and agree to the processing of your personal data by BÈLTIKÈ in accordance with applicable law and the stipulations of the Privacy Policy as indicated on the Site.

10. Modification of the T&Cs

BÈLTIKÈ may need to modify these T&Cs in order to adapt to its technological and commercial environment and to comply with the regulations in force. Any modification of these T&Cs will be published on the Site with a mention of the date of update. In the event of changes to the T&Cs and if you have a Customer Account, BÈLTIKÈ will notify you in advance, if possible, of the updated Site page. Continuing to access and use the Site after notification of the updates implies acceptance of the updates to the modified T&Cs.

11. Languages

These Terms are written in French, English and Spanish. Versions in German, Polish and Italian of the T&Cs may be presented on the respective versions of the Site, depending on the country from which it is accessed, for information.

12. Applicable law – Dispute

These T&Cs are subject to French law (subject to the mandatory rules of the Customer's country of residence). Any dispute relating to these Terms will be subject to the non-exclusive jurisdiction of the competent courts.
The Passenger is informed that he has the option of contacting the consumer mediator. It is provided that for any dispute of a contractual nature that could not be resolved within the framework of a complaint previously lodged with our customer service.
